Terms and Conditions

Introduction

YOU ARE ADVISED TO PRINT AND RETAIN THESE TERMS FOR YOUR RECORDS.

These are the Standard Terms and Conditions of Sale for 'JCP Hardware', a trading name of JC Plastics Limited, Unit 1a Barncoose Industrial Estate, Barncoose, Redruth, Cornwall TR15 3RQ. J.C. Plastics Limited is registered in England & Wales, Company No: 04842678, with Registered Office at: The Old Carriage Works, Morresk, Truro TR1 1DG ("the Seller", "We" or "Us"). Our VAT number is GB 591 1639 29.

By placing an Order and purchasing goods from JC Plastics Limited, you enter into a legally binding agreement with us on the following Conditions. If you are uncertain about your rights under these terms or require any explanation, please contact our customer service department using the details on our contact page BEFORE placing your order.

1. Interpretation

1.1 In these Conditions:

  • 'Conditions' means these standard Terms and Conditions of sale
  • 'Contract' means the contract for the sale of the Goods
  • 'Payment Card' means the credit or debit card or other payment system you use for payment
  • 'Delivery Area' means United Kingdom (including Highlands, Islands, and Channel Islands) and the EU
  • 'Goods' means the products you have ordered from our Website
  • 'Order' means any order placed by you with us for the supply of Goods
  • 'Order Form' means the electronic order form submitted by you
  • 'Website' means our online presence, currently accessible via https://jcphardware.co.uk

1.2 Unless the context requires otherwise:

  • Words in singular include plural and vice versa
  • Words importing masculine gender include feminine gender and vice versa
  • References to persons include bodies of persons whether corporate or incorporate

1.3 Headings are for convenience only and do not affect interpretation of these Conditions.

2. Basis of Sale

2.1 We shall sell to you only those goods specified in your order and accepted by us. We reserve the right to reject any order.

2.2 No Order is deemed accepted until confirmed by us via email or in writing.

2.3 No variation to these Conditions shall be binding unless agreed by us in writing or by email.

2.4 Any error or omission in our documentation is subject to correction provided the correction does not materially affect the contract.

3. Orders

3.1 The quantity, quality, and description of the Goods will be those set out in your Order (if accepted by us).

3.2 Orders are accepted at our discretion, typically when Goods are available, pricing is current, delivery is possible to your location, and your Payment Card is authorized.

3.3 Either party may withdraw from the contract in case of obvious errors or inaccuracies regarding the Goods on our website.

3.4 You are responsible for ensuring the accuracy of your Order and providing necessary information within sufficient time.

3.5 We reserve the right to make changes to Goods specifications to conform with statutory or EU requirements.

4. Price and Payment

4.1 The price of the Goods shall be as shown on our website at the time of order.

4.2 If prices increase between order acceptance and delivery, we will notify you and seek confirmation that the new price is acceptable. You have the option to cancel if the new price is unacceptable.

4.3 Prices do not include insured postage or packaging, which will be charged additionally and clearly displayed during checkout.

4.4 All prices include applicable value added tax.

4.5 By providing Payment Card details, you confirm the information is accurate and you are authorized to use the card.

4.6 If payment cannot be processed, we may cancel the Order or suspend further deliveries.

4.7 We will not share your personal information with third parties without permission.

5. Delivery

5.1 Delivery shall be made to the address provided in your Order Form.

5.2 We will make reasonable efforts to meet the delivery date or deliver within 30 days if no date is specified. We cannot be held responsible for delays beyond our control.

5.3 If delivery cannot be made within 30 days of the expected date, you may arrange a revised date or cancel for a full refund.

5.4 For multiple orders, partial deliveries may be arranged by mutual agreement.

5.5 Our liability for failed delivery is limited to the price of the Goods plus reasonable delivery/return costs.

5.6 Either party may cancel the contract for non-performance of delivery obligations, in which case we will refund all payments and reasonable return costs.

6. Risk and Property

6.1 Risk passes to you upon delivery. If you delay delivery, our responsibility ends on the agreed delivery date.

6.2 Ownership of Goods remains with us until payment is received in full. Goods supplied are not for resale.

7. Returns & Refunds Policy

Standard Items

7.1 We offer a 30-day return window from date of receipt for all standard items.

7.2 You will receive a full purchase price refund for items returned in original condition with packaging.

7.3 Return delivery charges are not refundable unless the item is faulty, damaged during transit, or incorrectly described.

7.4 If you opted for an upgraded delivery service, these additional charges are non-refundable under all circumstances.

Custom-Made Items

7.5 ABS Custom Made Cylinders and other custom products are subject to the following specialized return policy:

7.5.1 Returns accepted ONLY in the following circumstances:

  • Manufacturing fault in the product
  • Damage sustained during transit
  • Error on our part in fulfilling your order specifications

7.5.2 Returns will NOT be accepted for:

  • Incorrect measurements provided by customer
  • Key code specifications provided by customer
  • Color selections made by customer

Return Process

7.6 Account Holders:

  • Log in to your account and navigate to the 'Orders' section
  • Locate the relevant order and select 'Return Items?'
  • Specify quantity, reason for return, and preferred resolution
  • Add any necessary details in the comments field
  • Submit your request and await confirmation email

7.7 Guest Orders:

  • Contact our customer service team at sales@jcphardware.co.uk
  • Include your order number and return details
  • Our team will guide you through the process

8. Warranties and Liability

8.1 These Conditions do not affect any additional rights under a manufacturer's warranty/guarantee or your statutory rights.

8.2 You are asked to examine goods promptly after delivery. Any claim based on defects must be notified to us within 30 days from delivery or within a reasonable time after discovery if not apparent on inspection.

8.3 For valid claims notified within 30 days, you may reject the Goods for a full refund or request replacement.

8.4 For claims made after 30 days but within a reasonable time, we may replace the Goods or, at our discretion, refund the price with no further liability.

8.5 Except for death or personal injury caused by our negligence, our liability is limited to circumstances where:

  • There is a breach of legal duty of care
  • Such loss or damage is reasonably foreseeable
  • The loss is not increased by your breach of contract

8.6 We assume no responsibility for the contents of other websites linked from our Website.

9. Right to Cancel

9.1 You have a cooling-off period of 30 days after receiving the Goods to cancel the Contract and return the Goods at your cost for a full refund of the purchase price and delivery cost.

9.2 During the cooling-off period, cancellation must be given by written notice.

9.3 Goods must be returned complete and undamaged with all accessories and instructions in reasonable packaging condition.

9.4 The right to cancel does not apply to:

  • Personalized Goods
  • Goods made to your specification
  • Custom-made items as detailed in section 7.5

9.5 If we supply substituted Goods, your right to cancel remains as above, but return costs will be borne by us.

10. Communications

10.1 Electronic communications are deemed sent when entering an Information System outside the sender's control and received when entering a readable form in the recipient's system.

10.2 Postal communications are deemed received three days after mailing by first class or five days after mailing by second class.

10.3 To protect your interests, request delivery receipts for electronic communications and retain copies.

11. General

11.1 If any provision of these Conditions is invalid or unenforceable, it will not affect other provisions.

11.2 No term of the Contract is intended to confer benefit on any third party.

11.3 We will attempt to resolve disagreements efficiently. If you wish to take court proceedings, you must do so within the United Kingdom.

11.4 These Terms and Conditions are governed by the laws of England and Wales.
